Regulations dealing with looked-after children and carers are currently contained in the Arrangements to Look After Children (Scotland) Regulations 1996; the Fostering of Children (Scotland) Regulations 1996; and, to a lesser extent, the Residential Establishments - Child Care (Scotland) Regulations 1996. There have been a number of recent policy developments that have made an update of the existing regulations necessary.
One development is the publication of Getting it Right for Every Child in Kinship and Foster Care in December 2007. The Scottish government wants to reflect this approach by making the child's needs the starting point of the legislation. The new regulations apply to all looked-after children and carers, whether children are cared for at home, by foster carers or in a residential setting. Closing date 14 March
