Consultation of the week: The Funding Criteria for Child CareProceedings

The Legal Services Commission is seeking views on who should be eligible for funding for child care proceedings.

The consultation looks at two different aspects of funding for familylegal proceedings. It discusses who should be eligible for funding andresidential assessments.

The commission is considering introducing a reasonableness test. Theconsultation asks if some clients should have lower priorities forfunding than others, if the financial position of clients should berelevant to a reasonableness test and what impact the funding mentionedin the consultation would have.

Questions are also asked on whether residential assessments should falloutside of the legal aid budget because they are more aboutrehabilitation.
