ChildRIGHT: Parenting -- Dangerous presumption on shared parenting

Holly Rogalski, legal research and information officer at the Children's Legal Centre, asks if shared parenting orders are in the best interests of the child.

The Shared Parenting Orders Bill was tabled by Brian Binley, the Conservative MP for Northampton South, in July. The purpose of the bill is to create a legal presumption in favour of granting shared parenting orders.This is based on the presumption that it is in the best interests of the child for both parents to be fully involved in a child's upbringing.

As defined by the bill, a shared parenting order is "an order settling that both parents have a full involvement in the upbringing of a child, particularly in respect of major long-term issues, and requiring that the child must spend a substantial and significant amount of time with both parents."
