Childcare: Agency loses reference battle

A childcare recruitment agency has lost its fight to keep employee references confidential.

The Information Commissioner's Office, an independent body that promotespublic access to official documents, has ordered Tinies to discloseconfidential information to a nursery nurse after a long struggle(Children Now, 31 January-6 February). But the commissioner also saidthis ruling did not give all childcarers an automatic right to find outwhat previous employers have said about them in references.

The case arose after a nursery nurse went to the informationcommissioner after being refused a post with Tinies because the agencyfelt her references were below average. The nurse demanded to see thereference, but Tinies argued it had been given in confidence and apolicy of allowing employees to see references could stop formeremployers from being honest.
