What does the law say about educating your children at home? It's complex. Education is a fundamental right under the Human Rights Act 1998. Section 7 of the Education Act 1996 makes it clear that parents are responsible for ensuring that their child receives an efficient full-time education that is suitable to their age, ability and aptitude as well as any special educational needs. It can be provided at school or "otherwise", which can mean at home. Local authorities have a duty to identify children in their area who are not receiving a suitable education - and to intervene if necessary by, for instance, issuing a School Attendance Order that the child's parents can apply to have revoked.
