THE DILEMMA

Is a drug-using mother fit to look after her baby?

A family court adviser explains how it is all too easy to allow expert reports to confirm one's prejudices.

- A mother with a long history of drug abuse wanted to care for her six-month-old baby and it was my job to represent the child in care proceedings.

I knew the mother well and I had already represented her other children and had recommended care orders.

The mother was assessed by a psychologist, who gave a bleak prognosis of her ability to look after the child and manage her drug problem. This was consistent with my view on the history of the case. The mother asked for a second opinion, but I did not feel it was necessary. She applied to the court for permission to get a psychiatric assessment. I opposed it and the court denied her permission.
