Dee Point Primary School in Cheshire strictly enforces its rule, which does not allow snack foods on the premises.
Zara Owen's chocolate was intended as a treat for finishing her healthy sandwiches and yoghurt. Her mother, Lucy Owen, 22, said: "It is our choice what our children take in their lunchboxes." She has complained to the school and is raising a petition against the ban.
Dee Point Primary took the step after it found some pupils were consuming only sweets and crisps at lunchtime.
A spokeswoman for Cheshire County Council's education department said: "We know this issue is something the school is concerned about. Each school deals with these matters individually - we can only offer advice."
