Childright: Ask the experts

1 min read
Q: Does a child have a right of contact with their siblings?

A If a parent or a guardian is refusing a child contact with his or her sibling, it may be possible for the child to make an application to court for a contact order in their own right. If a child is making an application he or she must first obtain leave from a High Court judge. Alternatively, the application may be brought through an interested adult.

If leave is granted, the application will then be heard by the court. The guiding principle will be the best interests of the child who is the subject of the application.

Q: Can a child refuse to act as a witness?
