Assessment loophole could release offenders for a day

Concerns have been raised over an apparent loophole in the new system for assessing young offenders that will mean they are not subject to their sentence until the day after the court's judgement.

The Scaled Approach, due to be introduced next month, will require youthoffending teams to tailor interventions according to a young person'slikelihood of reoffending. The legislation behind the system andassociated youth rehabilitation order states that, if applied, orderswill not begin until the day after sentencing.

Tim Bateman, senior policy development manager at Nacro, said he fearschildren who have been remanded for a serious offence could be releasedfrom court without intervention for a day.

It is also feared young people could play the system by committing anoffence to deliberately remove an existing order for a short periodwhile they are resentenced for the breach.

"If it starts to annoy the courts then it may well incline them towardscustody in cases where it is touch and go," Bateman said.
