YJB closes Scaled Approach sentencing loophole

A loophole in the new system for assessing young offenders that meant they may not have been subject to their sentence until the day after the court's judgement has been rectified, the Youth Justice Board (YJB) has revealed.

The Scaled Approach, which comes into effect today (30 November), requires youth offending teams to tailor interventions according to a young person's likelihood of reoffending.

The legislation behind the system and the associated youth rehabilitation order (YRO) had stated that, if applied, orders would not begin until the day after sentencing.

Concerns were raised that children who had been remanded for a serious offence could be released from court without intervention for a day or young people could "play the system" by committing an offence to deliberately remove an existing order for a short period while they are resentenced for the breach.

The YJB has revealed that, along with the support of youth offending teams, it successfully lobbied for an amendment to the Coroners and Justice Act, which received royal assent on 12 November.
