Ombudsman uncovers huge SEND complaints backlog in Kent

A backlog of 170 unanswered complaints submitted to Kent County Council over delayed support for children with special educational needs and disabilities (SEND) has been uncovered during a Local Government and Social Care Ombudsman (LGO) investigation.

LGO Paul Najsarek found that the local authority had 141 overdue SEND stage one complaints, and a further 29 overdue stage two complaints.

The investigation uncovered that the council’s average response time to complaints exceeded the 20-day timescale set out in the its own policy – with responses to stage one complaints taking an average of 43 working days and stage two complaints averaging at 51 working days.

The delays came to light in an LGO investigation after the council failed to respond to a mother’s complaint that her son had not been provided with the speech and language therapy set out in his education, health and care plan (EHCP) for more than a year.
