Council to review SEND payments to families following ombudsman probe

Somerset Council has pledged to carry out a review of how it delivers direct payments to families of children with special educational need or disabilities (SEND) following an investigation by the Local Government and Social Care Ombudsman (LGO).
The mother of a child with an education, health and care plan (EHCP) were left £7,000 out of pocket by Somerset Council (known until 2023 as Somerset County Council)

The council, which is facing a funding gap of around £66m for 2025/26, is taking action over the process after the LGO found that the mother of a child was left £7,000 out of pocket while she waited for therapy funds to be released.

Families of children with a SEND subject to education, health and care plans (EHCPs) can access care through payments via personal budgets.

However, the payment delay meant she ran out of credit, putting payments for her child’s educational placement at risk.

The problem occurred as under the council’s process families’ personal budgets are paid via a third party, which should release funds when families need it.
