Youth Justice: Councils vow to retain dispersal zones despite High Court ruling

Last week, Lord Justice Brooke ruled that the curfew powers under Section 30 of the Antisocial Behaviour Act 2003 do not allow police or community support officers to use force to remove young people from a dispersal area after 9pm.

Councils can still allocate dispersal areas and impose a curfew on under-16s between 9pm and 6am. But the ruling means they will only be able to take them home if the young person is willing to go.

Despite this, all the councils contacted by Young People Now said that they were keeping dispersal areas.

A spokeswoman for Camden Council said: "We believe Section 30 is working and we will be following this closely."
