Scotland: Law change allows access to damages

The Scottish Parliament is to change the law to allow grandchildren, grandparents, same-sex partners and siblings who lose a relative in accidents to claim compensation.

The Damages (Scotland) Act 1976 restricts the definition of "immediatefamily" to spouse, opposite sex co-habitant, children, parent'step-parent or step-child. An amendment to the Family Law (Scotland)Bill last week will expand the definition.

Deputy justice minister Hugh Henry said the shape of families inScotland was changing and the law needed to reflect this.

"We are seeking to ensure that if a person is, for example, killed as aresult of dangerous driving those with close emotional ties have theright to seek damages," he said.
