Government to challenge Scottish Bill to enshrine UNCRC in law at Supreme Court

The government will challenge a bill passed by the Scottish parliament to enshrine the UN Convention on the Rights of the Child (UNCRC) in domestic law.

Last month MSPs voted unanimously for the United Nations Convention on the Rights of the Child (Incorporation) (Scotland) Bill to become law meaning public authorities will have to comply with children’s rights when the Bill is enshrined in law in September.

If the move is successful Scotland will be the first country in the UK and first devolved nation in the world to incorporate the UNCRC into domestic law.

However, UK ministers are concerned the legislation could place obligations on them meaning it would be beyond the scope of Holyrood's devolved powers.
