A school that shunned the admissions code of practice has been reported to Children's Secretary Ed Balls by the local government ombudsman.

All Saints Benhilton Church of England Primary School in Sutton, Surrey, failed to offer three families fair appeals after refusing their children places at the school, the ombudsman found.

Not only did the school fail to provide the families with a written statement explaining why their children were declined a place, but it also destroyed all records relating to the inadequate appeals hearings.

The Ombudsman ordered the school to offer the families fresh appeals, but the school has refused to hold any further hearings, on the basis that it is already fully subscribed.

Balls will now have to decide whether or not to intervene and force the school to offer the parents a fair appeal.
