AB and CD, a same-sex couple, enlisted the help of a fertility clinic to become parents. Prior to the successful treatment, Part II of the Human Fertilisation and Embryology Act (HEFA) 2008 came into force providing that a woman in a same-sex relationship may become a "parent" of a child born to her partner, where both parties agreed. In light of this, AB and CD signed consent forms purporting to give their bilateral agreement to AB's parental status. In 2010 CB gave birth to twin boys, registered by the couple with CD as "mother" and AB as "parent". After separation in 2011 AB applied for contact, opposed by CD who sought a declaration that AB was not a legal parent.
