Legal Update: Court Report - Request to take child to Turkey

Case name: Re H (A Child) Case number [2015] EWFC 39

Judge: Justice Cobb

Location: High Court (Family Division)

This case concerned, among other issues, an application by a mother for permission to remove her four-year-old child from the UK to take her on a two-week holiday to Turkey. The father opposed the application. The parents, who were formerly married and so shared parental responsibility, were Iranian nationals who both had indefinite leave to remain in the UK, the father having received asylum as a political refugee. A residence order made in relation to the child in 2013 permitted the mother to remove the child temporarily from the jurisdiction, except to Iran on the basis that travel to Iran was deemed risky for the family due to the father's former political activities. The court accepted that the father's concern was not the mother taking the child to Turkey, but that the mother would cross the border into Iran and stay.
