Sue Learner examines how the different services to support and advise children and their families involved in family law proceedings operate across the United Kingdom and outlines the differences between them.

ENGLAND

Family court advisers fulfil various roles in family court proceedings, including children's guardian, children and family reporter, reporting officer in adoption cases and guardian ad litem. All these roles involve safeguarding the welfare and best interests of children in public and private law cases across England.

The Children and Family Court Advisory and Support Service (Cafcass) is independent of the courts and social services and employs family court advisers who are all qualified social workers. Staff advise courts on the needs of children who have been separated from their families, while also helping parents resolve disputes following separation and divorce.

SCOTLAND

In Scotland the family court advisory service is part of the criminal justice system, and qualified social workers are eligible to work in the service.
