Director of children's services John Harris revealed he had been negotiating with a number of schools that had not seen eye-to-eye with the council.
He said: "We have made it clear that we encourage all schools to give priority to looked-after children. Where they have not done so we have challenged the school.
"We've had some schools that have come back to us and asked the question 'why?' and in those circumstance we have gone back and talked to them again."
But he insisted that the council's approach was "very much around persuading and engaging rather than threatening".
Many senior figures in the sector are concerned that foundation schools could undermine the Every Child Matters agenda because they are able to control their admissions.
