The Sentencing Guideline Council said both perpetrators and victims ofdomestic violence may ask the court to take account of children'sinterests and impose a "less severe" sentence.
It added: "The court must always consider the best interests of thechild. The court will wish to have regard, on the one hand, to theeffect on the children if the relationship is disrupted, and, on theother hand, to the likely effect on the children of any furtherincidents of domestic violence."
The proposed guidance also referred to the impact of domestic abuse onchildren.
The consultation on the guidance will end on 12 June.
