The judgment follows the challenge brought by the National Union of Teachers to employment regulations it believed could allow faith schools to sack gay or lesbian teachers (News, 17-23 March).
Doug McAvoy, general secretary of the NUT, said the judgment should prevent the "over-zealous and misinformed interpretation of the regulation that has been suggested and which caused concern to teachers in faith schools".
However, disappointed the judgment was not more clear-cut, the union may appeal.
