Disability: Parents take case to House of Lords

The parents of two disabled children, who lost their legal bid to secure council funding for essential adaptations to their home, are to take their battle to the House of Lords.

Michael and Henrietta Spink have made the decision after losing their latest attempt, at the Court of Appeal, to prove that the London Borough of Wandsworth had acted unlawfully by refusing to provide care equipment for their two sons, aged 16 and 12.

The court ruled that while equipment must be provided for those over 16 years old, parents of children below that age were subject to means testing.

The Spink's solicitor Yogi Amin, of law firm Irwin Mitchell, said any decision by the Lords would come too late for the family, as they are selling their home and plan to sail around the world on a specially adapted yacht.
