Court Report: Appeal of care and placement orders

Case name: H (Children); Case number: [2012] EWCA Civ 743; Judges: Thorpe LJ, Rafferty LJ, Norris LJ; Location: Court of Appeal

A mother appealed care and placement orders issued in respect to her children, ages one, five and seven, who were taken into foster care after the breakdown of their parents’ relationship. The mother suffered from schizophrenia, with yearly relapses.

She and her former husband had a history of domestic violence. The trial judge considered returning the children to their mother or making a long-term placement.

The mother had stabilised her condition over the past 13 months. Evidence was given by a consultant adult psychiatrist, a child and family psychologist, an independent social worker, the children’s guardian and the parties to the case. The psychologist, social worker and the guardian supported rehabilitation, despite acknowledging difficulties posed by the children’s antipathy.
