The Court of Appeal held that a care order must not be discharged as either a punishment or as a means of allowing the local authority to escape the burdens of supporting the child after his 16th birthday. Indeed, in certain circumstances a care order could remain in place solely to provide the benefits of the leaving care regulations. However, in this case, C had returned to live with his mother, and the local authority had fulfilled all its duties. Therefore, the trial judge was correct to hold that the care order be discharged and the appeal was dismissed.
