Court Report: Appeal against interim orders

Case name: K (Children) (2014) EWCA Civ 1195 Case number (2014)
EWCA Civ 1195

Judge: Lord Justices Ryder and Vos and Mr Justice Richards

Location: Court of Appeal (Civil Division)

This case concerned an appeal of the decision of the Swindon Family Court to remove two boys aged 14 and 12 from their mother, one of whom was placed in foster care under an interim care order, and the other with their father under a child arrangements order. The court allowed the appeal in part and set aside the orders. It considered that the most proportionate response in the circumstances was to return the children to their mother for the short interim period until the next full hearing, it being in the best interests of the children to remain together.
