The Scottish Government is seeking how to strike the right balance between proportionate protection of vulnerable groups and not compromising an individual's rights to privacy. The scheme responds to recommendation 19 of the Bichard Inquiry Report of 2004, following Sir Michael Bichard's inquiry into the Soham murders of 2002.
The Act creates the legislative framework for a new and robust vetting and barring scheme for those working with children and protected adults. The scheme is intended to ensure that people who are unsuitable do not gain access to children or protected adults and that those who become unsuitable are detected early. It also aims to reduce bureaucracy and streamline the disclosure process, delivering a consistent system that is easy to understand.
