Trust failed child in care due to poor SEND knowledge

“Bewildering” failings at a local authority-owned children’s trust left a looked-after child with SEND without education for nearly two years.

Worcestershire Children First (WCF), which has since lost its contract to provide children’s services on behalf of Worcestershire County Council, failed to name an appropriate school in the child’s Education, Health and Care Plan, due to lack of knowledge of the SEND system.

Local Government and Social Care Ombudsman Amerdeep Somal ordered the council to pay £11,060, apologise to the family and review staff training relating to the child’s missed education between June 2022 and April 2024, after finding fault leading to injustice.

Somal said of the child, who lived with a relative as part of a kinship care arrangement: “This child had a difficult start in life and, as corporate parents, the council had an even greater duty to ensure their welfare and educational needs were met.
