Judge accuses Gove of 'abuse of power' over BSF

The High Court has ruled that Education Secretary Michael Gove failed to consult properly before stopping school building schemes in six councils.

Nottingham, Luton, Waltham Forest, Kent, Newham and Sandwell all challenged the government’s decision to stop building projects following the government’s decision to cut the Building Schools for the Future (BSF) project.

Today, Mr Justice Holman ruled that as well as failing to properly consult on the cuts, Gove’s decision-making process was unlawful because the relevant legal equality duties were not discharged.

In making his decision Mr Justice Holman said: "The way in which the Secretary of State abruptly stopped the projects in relation to which approval had already been given […], without any prior consultation with the five claimants, must be characterised as being so unfair as to amount to an abuse of power."
