Gove faces legal challenge over scrapping Building Schools for the Future

Three local authorities have launched legal proceedings against the government over the decision to scrap the multi-billion-pound Building Schools for the Future (BSF) programme.

Labour-controlled Nottingham, Luton and Waltham Forest councils are all seeking permission to apply for a judicial review of Education Secretary Michael Gove’s decision to stop funding their school rebuilding projects.

The councils claim that Gove’s decision was contrary to their legitimate expectation that the funding for their BSF schools would be provided.

The authorities also claim that the decision was irrational, since 1 January 2010 was used as an "arbitrary" cut-off date for stopping funding for BSF projects.

David Mellen, Nottingham City Council’s lead member for children’s services, said the council has been exploring a number of options in its bid to secure funding to carry out the planned refurbishment of local schools.
