Attacked children's home worker wins constructive dismissal case

A children’s home practitioner who was assaulted by a young person she had previously raised concerns about has won a case for constructive dismissal against the local authority she was employed by.

An employment tribunal found that Bradford City Council failed to act on concerns raised by the female practitioner or support her after she was attacked at the local authority-run home. She was subsequently on long term sick leave and eventually resigned around two years later.

The Bradford employment tribunal heard that the practitioner was assaulted by the young person twice between June and July 2019 and that the council failed to protect her by not removing the child from the home, which she was acting manager of at the time.

The council also failed the practitioner by not putting in place a stress management plan or adequately addressing her official grievances, according to her claim.
