Social Care News: Asylum - Government may back-track on law

The Association of Directors of Social Services has welcomed news that a policy that can lead to failed asylum seekers having their children taken into care if they refuse to leave the UK, could be scrapped.

Section Nine of the 2004 Asylum and Immigration Act allows theGovernment to stop benefits to families who do not voluntarily leaveBritain, which could leave families destitute.

Home Office minister Tony McNulty said last week that pilot trialstesting the policy were still being assessed, but added: "If it's notworking, I want proper discussion to see how we deal with thisissue."

The development comes as the High Court rejected a Congolese mother'sclaims that cutting off support breached the Children Act and HumanRights Act.

The pilot test has already resulted in four children being taken intocare and 46 families "going underground".
