The order, laid by Lord Williams of Mostyn, paves the way for a commissioner to take up a four-year appointment.
Williams said the role would be accountable by use of annual reports, but it would remain largely independent and free to determine its own priorities.
Focusing on children and young people from birth up to the age of 21, the role will encompass all public authorities whose activities affect children and young people.
The role is expected to be formally in place by the office of the first minister and deputy first minister as early as March, and is then likely to be followed by a two-month recruitment process.
