The decision arose out of a complaint by a mother against Lancashire County Council over their handling of a case involving her 17-year-old son, whose home life had broken down. During the investigation, it came to the attention of the Local Government Ombudsman (LGO) that the young person may have been caused an injustice, as the local authority placed him in bed and breakfast (B&B) accommodation.
What were the circumstances of the case?
The young person, who had complex behavioural, emotional and communication difficulties, and who was a cannabis user, left a special school he had been attending and moved in with his father, as his mother was finding it difficult to deal with his violent behaviour. During the time he lived with his father, his behaviour and drug use became increasingly problematic, and he was arrested and bailed on several occasions. The placement with his father broke down. The local authority placed him in public B&B accommodation for five days.
