Legal Update: In a Nutshell - Proposed regulations for young carers

Draft regulations provide guidance on rights for young carers that were introduced in the Children and Families Act 2014.

Latest figures from the Office for National Statistics indicate that there are around a quarter of a million children and young people caring for a relative; however, some charities warn that these figures are a significant underestimate. Having caring responsibilities can have a negative impact on a child's education, job prospects, health and wellbeing, and can impair their development.

New entitlement to have needs assessed

Section 96 of the Children and Families Act 2014 introduced new provisions aimed at improving how young carers and their families are identified and supported by local authorities. The changes were made through amendments to the Children Act 1989. According to the new provisions, all young carers, as of April 2015, will be entitled to an assessment of their needs by their local authority. A "young carer" is defined under the 2014 act as "... a person under 18 who provides or intends to provide care for another person (of any age)", except where it is done as work (paid or voluntary).
