This case concerned the care of a child, ED, who is of Czech Roma decent, but is in foster care in the UK. The local authority's plan consisted of care and placement orders; however, Justice Mostyn in his judgment felt this was not in the best interests of the child, as it would result in the severance of ethnic and familial ties.
The mother of ED wished to dismiss the current proceedings and have ED placed back with her and the father, however this was not in the best interests of the child owing to the familial circumstances of past abuse and criminal activity on the part of the father and the current living situation which may place ED at risk.
