The case concerned an application for the return of a nine-year-old child, A, to Lithuania pursuant to the Hague Convention of the Civil Aspects of International Child Abduction 1980. The central foundation of the convention is that, where a child has been unilaterally removed from their country of habitual residence in breach of someone else's custody rights, then they should be swiftly returned to that country for the courts to decide on their future.
In this case, the child's mother, a Lithuanian citizen, had taken A to England to live permanently. Court orders in Lithuania provided that A live with her mother and have contact with her father.
