Legal process for young defendants to be examined after adult court rape case

The government has agreed to examine the legal process for young defendants and witnesses following concerns raised over the case of two 10-year-olds boys convicted of attempting to rape an eight-year-old girl.

Liberal Democrat justice minister, Lord McNally, revealed the decision following a debate in the House of Lords over the age of criminal responsibility.

In a letter responding to calls made by crossbench peer Baroness Deech to raise the age of criminal responsibility and not hold trials of children in open adult courts, he said the concerns will be passed on to the Ministry of Justice for consideration.

Meanwhile, in light of the controversial trial of the two 10-year-olds tried in an adult court, McNally announced that after the sentencing next month, judge Mr Justice Saunders will pass his views on the procedure of the case to the Lord Chief Justice, who will then decide whether to bring the issue to the attention of ministers.
