What participation rights do pupils in England have? Well, there is section 157 of the Education and Skills Act 2008, which amends the Education Act 2002 and requires governing bodies of maintained schools to invite and consider their pupils' views on matters yet to be prescribed. That section applies to Wales as well as England.
"Yet to be prescribed"? We're still waiting for a consultation paper on the new participation duty to describe what "prescribed" actually means. But there are other areas where specific rights are being introduced. For instance, the government is consulting on allowing young people aged 16 and above the right to appeal against a decision to permanently exclude them from school rather than have to depend on their parents to do so.
