This case concerned the relocation of a child, A, to the Czech Republic. A's mother was a Czech national and her father was British. Her mother wished to move with A back to the Czech Republic.
The judge at the High Court had held that the mother could move the child to the Czech Republic and consequently set the amount of contact that the father could have in accordance with this permission to move.
The father appealed both the decision of the High Court to allow A to move abroad and the amount of contact that he had been awarded.
The Court of Appeal discussed the difficulties faced when applying the leading case of Payne v Payne to cases of this nature. Payne requires the Court to take into consideration the intentions of the parents and their motivation for moving the child or requesting that they remain in the UK.
