The high level of children's custody in England and Wales is a scandal.

Our custody rate is higher than nearly every other European Unioncountry and costs an enormous amount of money - 313m out of theYouth Justice Board's (YJB) total budget of 515m, according tothe latest YJB business plan.

It makes no impact on re-offending rates and subjects children toexperiences which do not meet their emotional and developmental needs,and are sometimes abusive.

The Crime and Disorder Act 1998 tells us that a primary function of theYJB is to advise the government on the juvenile justice system, in otherwords "to speak truth unto power". The act also states the YJB "shallnot be regarded as the servant or agent of the Crown". In other words,its advice should be independent and it should not shrink from offeringunpopular advice.
