Local authorities have additional duties to provide for a new category of young care leaver under the Children and Young Persons Act 2008.

A number of provisions in the Children and Young Persons Act 2008 came into force on 1 April 2011. The act amends the law relating to care leavers as set out in the Children Act 1989.

Prior to the Children and Young Persons Act 2008 coming into force there were four categories of care leavers. These remain unchanged.

What are the existing categories of care leavers?

Eligible children are young people aged 16 and 17 who have been looked after for at least 13 weeks since the age of 14 (at least some of that period must have fallen after the child reached the age of 16) and who are still being looked after.
