Children's Secretary Ed Balls has called for changes to the law on childcare registration to clarify the situation for those with reciprocal arrangements.

Childcare: who has to register with Ofsted?

In a recent high-profile case, two police officers who looked after each others' children were told by Ofsted that they must register as childminders, as their childcare arrangement contravened Section 71 of the Children Act 1989. Section 71 provides that if a person is caring for a child under the age of eight for a period of more than two hours a day for "reward" then that person must register as a childminder. "Reward" is not defined in the Children Act 1989, but Ofsted has defined it as including reciprocal child care, as each police officer was getting a benefit.
