The new system for taking children into care is failing in its corepurpose to avoid unnecessary court action, according to a Ministry ofJustice report.
The study, seen exclusively by CYP Now, examines how the Public LawOutline has worked since it was introduced in April last year.
It says parents are not being given the opportunity to resolve problemsbefore being taken to court - a key aim of the new system.
Under the Public Law Outline, local authorities are required to providedetailed information about the case to speed up court proceedings. Aspart of this, they must send a letter to the parent telling them of thethreat of court proceedings, triggering access to free legalsupport.
