The Law Commission is reviewing the issues around asset disposal for non-married couples who have lived together and split up.

The Law Commission hasbeen reviewing issues in relation to cohabitants, the most recent ofwhich looks at the financial hardship that can follow the termination ofa relationship.

What about common law marriage? Common law rights are a fallacy. No onehas automatic rights regarding the disposal of assets when arelationship ends. Unless of course the couple has been far-sightedenough to draft a written agreement to set out their intentions if sucha circumstance occurs. The Civil Partnership Act 2004 is not availableto heterosexual couples who choose not to marry.
