Parent threatens legal action against SEN pathfinder council

A council could face legal action for rejecting a parent's plea to be given direct payments to finance her son's speech and language therapy at school.

The government introduced secondary legislation earlier this year to allow 20 pathfinder areas to trial different ways of supporting children with special educational needs (SEN) and disabilities, including direct payments or personal budgets.

Wiltshire County Council is one of the local authorities taking part in the trials. Under the terms of the legislation - referred to as the SEN pathfinder order - Wiltshire is “required” to provide parents with information and advice about direct payments for SEN and disability support.

It is also required to consider any request for a direct payment. If a local authority decides it is not going to offer direct payments, it must give its reasons for doing so, and parents are entitled to ask for a review of any such decision.
