Austin Molloy, agreed to step down from his position as chairman of the bench at Blackburn Magistrate's Court, after a clerk and the mother of one of the boys complained about the words he used to describe the young offenders.
Molloy is reported to have said the 16-year-old boys, who were found to have scribbled racist and sexually abusive graffiti on prayer books, were "absolute scum" when passing sentence.
A spokeswoman for the Judicial Communications Office said Molloy had not been suspended but the situation was being investigated to see if further action is required.
