Justice rules watered down

Youth Justice
New European guidelines on child-friendly justice have been watered down prior to being finalised, CYP Now has learned.

A draft document published last year by the Council of Europe containeda provision for criminal records to be wiped clean at 18, and alsocalled for youth justice cases not to be heard in adult courts.

Neither of these provisions appear in the final draft, set to befinalised in November. The final draft does however continue to call foran end to the naming and shaming of young defendants.

It also states that custody should be used as a last resort when dealingwith young offenders, and that they should be detained for the shortestamount of time possible.

The document will not be legally binding but is likely to influencestandards, shape opinion and inform debate within the sector.
