The Honourable Mr Justice Keith set aside the decision of a special educational needs and disability tribunal for making a mistake in law and ordered Caerphilly County Borough Council to pay costs to the parents of a boy with severe learning and language difficulties.
John Wright, chief executive of charity The Independent Panel for Special Education Advice, said decisions such as this happened on a monthly basis.
Proposals in a Department for Constitutional Affairs white paper, Transforming Public Services: Complaints, Redress and Tribunals, to introduce a new upper-tier to tribunals would reduce the number of cases going to the High Court, he said. "This would be swifter, cheaper and altogether more accessible to parents," he added.
