The High Court has set out what factors should be taken into account when a judge orders a residential assessment as part of child care proceedings.
Jane Worsey, legal adviser in the Legal Services Commission's childrenand family team, said the ruling was the latest in a string of cases onhow costs are split between local authorities, parents and children.
"This judgment gives guidance on what information the court needs whenlooking at assessments," she said. This includes what happens when theassessment includes therapy, training or teaching. Worsey said the casedid not affect the core assessment work done by local authorities.
The judgment is available in The Times, 25 August 2006, p70.
